Moreover, RWE Dea shall be liable – irrespective of the legal grounds, including the law of tort – only if

- RWE Dea, its management bodies or executives cause any loss or damage with gross negligence or willful intent or culpably violate a material contractual (cardinal) duty in a manner endangering the contractual purpose,

or

- any other vicarious agents of RWE Dea not belonging to the management bodies or executives violate a material contractual (cardinal) duty with gross negligence or willful intent in a manner endangering the contractual purpose.

If any management bodies or executives of RWE Dea do not violate a cardinal duty with gross negligence or willful intent, then RWE Dea shall be liable for such typical cases of loss or damage that were reasonably foreseeable at the time of entering into the agreement. This limitation on liability also extends to include the extent of loss or damage.

RWE Dea’s liability according to the [German] Product Liability Act and other mandatory statutory provisions is unaffected by the limitations on liability referred to above. In all other cases, any liability on the part of RWE Dea is excluded.
